Mind and Run Terms and Conditions
ARTICLE 1: APPLICATION
The present general conditions of sale govern the activity of Mind and Run Eurl, a company with capital of €7,000, registered with the RCS of Aix en Provence under the SIRET number 82032314500012, whose registered office and place of business is located at 25 rue de Cuques 13100 Aix en Provence.
These conditions are brought to the attention of any individual or legal entity wishing to make a purchase via the www.mindandrun.com website or by mail order (hereinafter referred to as "the customer") and set out the contractual provisions and conditions applicable to any reservation or service.
Mind and Run reserves the right to modify or cancel the terms and conditions and the content of the site at any time at its sole discretion and without prior notice. The terms and conditions of this contract apply to all visitors to www.mindandrun.com and should be read carefully before use.
ARTICLE 2: ACTIVITY
Mind and Run a pour objet l’organisation et la commercialisation de jeux d’évasion grandeur nature en groupe de 2 à 50 personnes, organisés en son établissement situé au 25 rue de Cuques 13100 Aix en Provence.
ARTICLE 3: ORDERS - RESERVATIONS
Access to Mind and Run facilities and services is subject to reservation via the www.mindandrun.com website, by telephone (04.42.52.56.73) or by signing a quotation for companies.
Reservations are made for a specific day, time and room(s), and are only valid for that time slot.
Reservations are subject to availability, which is updated in real time on the website.
The reservation will be firm and definitive only after the customer has received a confirmation e-mail from Mind & Run.
Cas particulier de réservations multiples :
Dans le cas de réservations multiples (2 salles de jeu ou plus) par un même client réservant sur le site internet. Mind and Run se réserve le droit afin d’éviter toute défection de demander le paiement de la totalité de la prestation avant l’évènement. Le paiement de la totalité sera une condition indispensable pour la validation définitive de la réservation multiple et suplantera le mail de confirmation reçu. Mind and Run prendra contact avec le client réservataire dans un délai raisonnable et fera le nécessaire pour lui faciliter le paiement à travers l’envoi de liens de paiements individualisé permettant à chaques membres de l’équipe de régler sa place de jeu.
3.1 - ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
The present Conditions can be read directly on the www.mindandrun.com website . The fact that the Customer ticks the box "I accept the terms and conditions of sale" when placing an order or signing a quotation automatically implies the Customer's express acceptance of these Terms and Conditions without restriction or reservation. By this act, the Customer acknowledges having read and understood the present Conditions and accepts them.
Purchasing by e-mail also implies acceptance of these Terms and Conditions, which the customer acknowledges having read, understood and accepted in the aforementioned conditions.
3.2 - PRICES
Prices are indicated in euros, inclusive of all taxes. They include the VAT applicable on the date of the order. Any change in the applicable rate may be reflected in prices after the date on which the new rate comes into force. The VAT rate applied is 10% of the value of the services sold in Metropolitan France, Corsica and Monaco, in accordance with current legislation.
Mind and Run reserves the right to modify the prices shown on its website at any time.
In all cases, the service will be invoiced on the basis of the rates in force and mentioned on the site at the time of booking.
Cas particulier de réservation pour 2 joueurs:
Dans le cas d’une réservation pour 2 joueurs, le tarif appliqué est indentique à celui de 3 joueurs. Dans ce cas particulier le prix par personne n’est plus celui indiqué sur la page d’accueil du site et il faut tenir du compte du prix affiché dans le panier de réservation qui fait foi à lui seul.
3.3 - PAYMENT
Mind and Run accepts payment on the www.mindandrun.com website by credit card (Carte Bleue, Visa, Eurocard, Mastercard), Pass Culture or ANCV Connect. We will debit your account when you finalize your order on the site.
Mind & Run met en œuvre tous les moyens nécessaires pour assurer la sécurité et la confidentialité des données transmises en ligne (paiement en ligne sur le site) via son partenaire de réservation 4escape. Dans ce but, le site utilise un mode sécurisé de paiement SSL (Secure Socket Layer). La transaction s’effectue via le système Systempay de la caisse d’épargne, qui seul dispose des informations bancaires fournies sur le site au moment du paiement.
Private customers must pay at least a deposit equivalent to one place per room reserved on our website to validate their reservation. The balance is payable on site on the day of the event, before the gaming session.
3.4 - PROFESSIONALS
For business bookings, the requesting company must submit its request by e-mail or directly via the dedicated form on the website. An estimate will be drawn up and sent to the customer. Signing this document implies acceptance of the service and of the general terms and conditions of sale, in particular article 5. A deposit of 50% of the invoice amount will be requested by cheque, bank transfer or credit card upon signature of the quotation. Signing the quote commits the customer to paying for the entire service, even in the event of a no-show. However, the number of participants may be modified 15 days before the date of the event, up to a limit of 10% of the number of participants defined at the time of quote validation. The balance of the invoice must be paid on the day of the event, unless otherwise stated on the quote.
ARTICLE 4 - CANCELLATION (not applicable to quoted services)
REMINDER: The service is fixed for a specific time/date/room chosen by you at the time of booking. Just like booking a train or concert ticket, this implies the privatization of one or more game rooms, and the mobilization of one or more employees specially assigned to look after your team.
The deposit is therefore ONLY used to secure your gaming room, and does not cover cancellation costs. (A game postponement is equivalent to a cancellation).
IN THE EVENT OF CANCELLATION OR CHANGE OF SCHEDULE / DAY / CHOICE OF PLAYING ROOM :
With Postponement / Cancellation Guarantee
With our Cancellation Guarantee, you're protected against unforeseen events and enjoy total flexibility.
If you have subscribed to the Cancellation Guarantee at the time of booking, you can cancel your reservation right up to the last minute. Only the deposit paid will be lost, but you will not be charged the full price of the game session. No proof required
The Cancellation Guarantee is valid for 1 booking. In the case of multiple bookings, you will need to add the Cancellation Guarantee to your basket if you wish to benefit from it for several bookings. It should also be noted that once a date, time or venue has been changed thanks to this guarantee, it is deemed to have been "consumed", so that it is not possible to postpone the service indefinitely with the service provider using a single guarantee.
The Cancellation Guarantee is non-refundable, non-exchangeable and non-transferable to another reservation.
The price of the Cancellation Guarantee is a fixed €5 incl. VAT. It can only be taken out at the time of purchase.
In the event of cancellation more than 7 days in advance, the Cancellation Guarantee will also enable automatic reimbursement of the deposit paid in the form of a credit note usable for one year.
Without Postponement/Cancellation Guarantee
the deposit paid will be forfeited and the balance due will be debited from the credit card used for the deposit, regardless of the reason for the customer's cancellation.
Similarly, any customer delay in excess of 15 minutes will result in the cancellation of the game under the same conditions as the previous paragraph.
4.1 Specific case for the withdrawal of gift card purchases
The Purchaser, or failing this, the Beneficiary, shall inform Mind and Run of his or her decision to withdraw from the contract by sending an unambiguous statement expressing his or her wish to withdraw, before the expiry of the period stipulated in Article L. 121-21 (14 days after purchase), by sending an e-mail to contact@mindandrun.com.
On receipt of the request for reimbursement within the time limit set, Mind and Run will make the reimbursement to the means of payment originally used by the customer within 14 days of receipt of the request for withdrawal.
ARTICLE 5 - ACCESS TO FACILITIES AND HOUSE RULES
Each performance is organized for groups of 3 to 42 people, lasting 60 minutes of play and 30 minutes including welcome and debriefing.
All groups must be present at the start time of the performance. As the proposed service operates on the basis of a bookable timetable, players who fail to turn up at the time indicated may be refused access to the game without being able to claim any refund. In the same way, players who have been informed of the content and progress of the game before the session will not be entitled to any refund if they decide to leave the game during the session.
A minimum age limit is set for access to the facilities. The customer is informed of this age limit, which varies according to the room reserved, at the time of booking. If the minimum age is not respected, players who are too young will be refused access without reimbursement. In all cases, players under 16 years of age must be accompanied by an adult in the room, regardless of the room chosen, and therefore count as a player.
Identification may be requested prior to the game session, and access may be refused if certain players are under the required age, without any refund being requested. Children/infants may not participate in our games or even enter them. The "Text Killer", "Conjuration" and "Stranger" themes are not suitable for people with heart problems or pregnant women.
People with mild visual or hearing impairments can use the facilities if they are part of a group containing at least people without disabilities. Unfortunately, the nature of the game is not suitable for blind people.
It is strictly forbidden to bring food or drink into the game room.
Smoking and vaping are strictly prohibited throughout the facility.
Animals are strictly forbidden access to the facilities.
Persons under the influence of alcohol or drugs may be refused entry and their game forfeited if their attitude is deemed inappropriate. Similarly, Mind and Run reserves the right to refuse entry to any person whose behavior is deemed inappropriate, without any refund.
Players must also leave their bags and personal belongings, in particular sound or video recording equipment such as cell phones, in a locked locker provided for this purpose.
For the purposes of the game, players will be required to handle the objects and installations present. It is strictly forbidden to break or damage these objects. Mind and Run may invoice customers for any damage caused, whether intentional or unintentional.
In order to preserve the interest and confidentiality of the game, all sound or video recordings and photos are strictly forbidden. It is forbidden to reveal any details of the game, directly or indirectly, to the public.
ARTICLE 6: PROTECTION OF PERSONAL DATA
By booking through the Mind and Run website, the customer consents to the collection of personal data essential for the proper processing of orders.
By providing this personal information, the customer authorizes Mind & Run to communicate with him/her about commercial news. However, Mind & Run undertakes never to communicate this information to third parties except in the cases provided for by law.
In accordance with the French Data Protection Act of January 6, 1978 and Article 43 of the amended September 30, 1986 Act, this website has been registered with the Commission Nationale Informatique et Libertés (CNIL), which has issued receipt number 1960721.
Customers have the right to access, modify, rectify and delete data concerning them (art. 34 of the French Data Protection Act of January 6, 1978).
To exercise this right, please contact Mind & Run by post at the head office (25 rue de Cuques, 13100, Aix en Provence).
As part of the game session, customers are filmed in real time so that they can be assisted in the game if necessary. No video or audio recordings are saved by Mind and Run. Similarly, a group photograph will be taken at the end of the game session. This photo will be e-mailed to the customer and published on the Mind and Run Facebook page. Customers who do not wish this photo to be published must request it.
ARTICLE 8 - Specific conditions of sale "BOX for Rent".
The purpose of these specific conditions is to define the terms and conditions for the rental of "BOX" products between Escape Game Mind and Run and its customers.
Placing an order with us implies that the customer fully accepts our general terms and conditions and agrees to waive the right to invoke his/her own. Products and websites are not contractual. We reserve the right to make any technical or aesthetic changes we deem necessary, always with a view to improvement.
8.1 : QUOTATIONS & RATES
The site reserves the right to modify prices at any time. However, the price cannot be modified once the order has been validated.
Our prices can be discounted through commercial operations, coupons, etc.
For any request outside these conditions, an estimate can be drawn up on request.
Boxes are reserved for a specific day, product and time, and are only valid for that time slot. Reservations are subject to availability. The reservation will be firm and definitive only after the customer has received a confirmation e-mail.
8.2: ORDERS
You can place an order on the www.mindandrun.com website or by telephone, chat or e-mail. The order will only be final after payment and receipt of a confirmation email. The order can only be validated if the mandatory fields have been duly completed.
The simple fact of placing an order by validating the identification, choice of items and payment stages implies that the customer accepts in full and without reservation these general terms and conditions of sale, which constitute the rental contract between the customer and the seller (Mind and Run).
Mind and Run cannot be held responsible for food allergies. Customers with allergies must specify them to the service provider and, if in doubt, ask for details of the food content. Aperibox" boxes contain alcohol. The buyer is therefore informed at the time of ordering that the abuse of alcohol is dangerous to health, not recommended for pregnant women, and that the sale is forbidden to minors. The person picking up the box must be of legal age and have an identity document to prove it. Failing this, the box will not be delivered to the customer, and the order will be cancelled without the customer being able to claim any reimbursement whatsoever for the order placed. Finally, food products in the box must be consumed within 4 hours of the time the customer collects the product from our premises. Au dela Mind and Run accepts no responsibility for the integrity and consumability of the products included.
8.3 : SECURE PAYMENT
The user must pay the total amount of the order by credit card or ANCV connect or pass culture when placing the order.
They may also pay in cash or by paper ancv vacation cheque, by making an appointment to come and make the booking.
Mind and Run reserves the right to cancel the entire order process in the event of refusal to authorize payment by accredited bodies, partial payment or ongoing disputes.
After you have placed your order, we may ask you to provide proof of address and identity to prevent fraud.
8.4 : RECEPTION
Products purchased on the website can be picked up at Mind and Run escape Game 25 rue de cuques- 13100 Aix en Provence. Pick-ups are by appointment only. The customer must contact Mind and Run once the reservation has been made to arrange a pick-up time. The customer is solely responsible for transporting the rented box. It is strongly recommended that the box be transported in a vehicle. It cannot be transported by public transport or any other vehicle. Mind and Run will assist the customer in loading the rental unit into their vehicle if it is parked in the designated parking area in front of the facility.
8.5 : DEPOSIT
A deposit of 300€ (three hundred euros) will be required on delivery by credit card only. (MAex card not accepted) please ensure you have sufficient funds on the card presented.
Without this deposit, the box cannot be returned to the customer. No refund will be possible.
Any anomaly (damaged, broken or missing product, etc.) must be reported by the customer when returning the cooler and will result in the full or partial cashing of the deposit.
8.6 : RETURNING BOXES
To ensure that the BOX is recovered in the best possible conditions, we advise the customer to carry out an inventory to ensure that all non-consumable items have been returned to the cooler. To this end, a list is given to the user at the end of the puzzle. The cooler must be returned before noon on the morning following the rental period. Any delay in the time set by the service provider (before noon on the following day) will result in charges being deducted from the deposit.
Mind and Run reminds its customers that the BOX must be used for its intended purpose. Should the equipment contained in the BOX (or the BOX itself) be damaged, soiled or incomplete on return, the deposit will be forfeited.
If the cost of repairing or replacing the damaged or missing item(s) exceeds the amount of the deposit, the difference will be invoiced to the customer.
8.7: CANCELLATION & FORCE MAJEURE
In accordance with article 121-21-8 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities which must be provided on a specific date or at a specific time. Consequently, no reservation may be cancelled or refunded except in the event of cancellation by Mind and Run escape game alone. In the latter case, the amount of the initial reservation will be refunded. Refunds can only be made to the credit card used at the time of purchase.
The performance of the obligations incumbent on each of the Parties under these General Terms and Conditions shall be suspended by the occurrence of an event constituting force majeure in the usual sense of the term, including but not limited to natural disasters, acts of public authority, embargoes, strikes, exceptional weather conditions preventing delivery, insurrections and riots. This list only constitutes potential cases of force majeure, subject to the sovereign appreciation of the courts.
The Party wishing to invoke such an event must immediately notify the other of its commencement and, where applicable, its termination, failing which it cannot be relieved of its liability.
ARTICLE 7 - APPLICABLE LAW AND JURISDICTION
Customers ordering via the www.mindandrun.com website are deemed to be purchasing in France and are therefore subject to French law.
In the event of disagreement after having made a written complaint to Mind and Run and in the absence of a satisfactory response within 60 days, the customer may refer the matter to the Tourism and Travel Ombudsman of which Mind and Run is a member. In the event of persistent dispute, in the absence of amicable agreement between the Parties, jurisdiction will be given to the competent courts of Aix en Provence.
These terms and conditions are effective as of May 1, 2016.
